Affidavit of Nanavati Commission

I, Srd. Sampuran Kaur, W/o Late Nirmal Singh, aged about 60 yrs., housewife, R/o B-38/B, Tilak Vihar, New Delhi-18, do hereby solemnly affirm and declare as under:- 1. That During Oct./Nov.`8, I along with my family were residing at WZ-241, Raj Nagar, Palam Colony, New Delhi, since 1979. 2. That my husband Nirmal Singh was brutally killed by one Balwan Khokkar regarding which I filed a detailed report with the S.H.O., P.S. Delhi Cantt. which reads as follows:-

Sir, Respectfully I beg to state on 1-11-84, at about 9:30 we hear loud noise and within minutes about 500 persons set fire to Gurdwara after that they came to our house No. D-85 (Old WZ –241). They started beating us and set our house on fire, when they left we were trying to put out fire. Meanwhile mob lead by Pradhan Bagdola Village, Mr.Mohinder Singh and Balwan Khokhar came back at about 12:30 A.M. Balwan Khokhar came to our house and asked my husband S. Nirmal Singh to come with him for compromise. Without suspecting anything my husband sat behind him on scooter. He straight went to mob standing near Mr. Dhanraj’s shop. He handed my husband over to the mob. They took rope from Mr. Dhanraj’s shop. My daughter Nirpreet Kaur, ran crying towards them. Some people stopped us but my daughter reached near my husband and saw him being tied. They poured kerosene or petrol on him and set my husband on fire. We ran back to our house. Mob was again set my house on fire. (whatever left) Mean while an Airforce Transport came near our house some persons from Air force (S. Santokh Singh) put us in the Garhi and brought us to Air force Station. We visited our house on 6-11-84. It has been completely burn down and looted. We had about 20 tolas of gold and Rs.15,000/- in cash which was kept for petrol and truck payment. A brand new scooter purchased in August, 1984, has been burnt. Our house has been raised to ground and all house hold property looted. Documents as scooter registration certificate (Vespa XE) Ration Card, our plot registry, Taxi stand and telephone papers, pension book, this charge certificates and all other papers have been burnt. I am not left with anything. You are requested to please recover my property and take action against looted and killer of my husband.

Sampuran Kaur 3. That after the lodging of above said complaint, I have never been summoned by any court for statement and I do not know whether the guilty person (s) have been punished or not. 4. That I suffered the following losses:- a. Loss of property i. House Rs.2,50,000-00 ii. Household goods Rs.2,50,000-00 ------------------- Total Rs.5,00,000-00 Copy of the report of loss dated 15-11-84, lodged with the SHO, P.S. Delhi Cantt. is enclosed as Annexure-2 5. That I have been given a compensation of only Rs.20,000/- (Rs.10,000/- in 1986 and Rs.10,000/- in 1990) against loss of Rs.5 lakhs. Apart from the above, I got the compensation on account of death of my husband. 6. That I am entitled to compensation of Rs.4,80,000/- on account of damage to house, arson and looting of household goods / articles as stated above. |
