Affidavit of Nanavati Commission

I, Sukhwant Kaur, W/o S. Nachhitar Singh, aged 42 yrs., R/o RZ-20 / H, Main Sagarpur, Gali No. 5/1, New Delhi, do hereby solemnly affirm and declare as under:- 1. That I am staying at RZ-20 / H, Main Sagarpur, Gali No. 5/1, New Delhi, since my marriage in 1981. 2. That my husband is staying in the house since 1977. He was working as turner in a workshop at Hari Nagar. 3. That in Nov.`84, I was staying at above address along with my mother-in-law, my husband, devar, devarani and my 2 ˝ years old son. 4. That on 31st Oct.`84, I started hearing loud noise in our area from 6 P.M. At about 9 P.M. I saw many people running across the road in front of my house carrying utensils. Later, I learnt that a shop of sikh has been looted. 5. That at about 10 P.M. on 31st Oct.`84, a mob of 250 – 300 persons came to our house. Immediately they started beating my husband S. Nachhatar Singh and devar, S. Piara Singh with iron rods and lathis which they were carrying with them. They beat them till they fell down unconscious 3 – 4 persons from the crowd forward and said “they have died, let us move forward”. Before leaving. 6. That they put the house on fire. They threw some powder on my husband and my devar. My husband and devar being unconscious could not protect themselves from fire. 7. That after the mob went away, I along with my mother-in-law and devarani, dragged the unconscious bodies of my husband and devar to our neighbor, Mrs. Bala’s house. Mrs. Bala is still living there. We stayed in the house of Mrs. Bala till 1st Nov.`84, afternoon. 8. That on 1st Nov.`84, by noon, mob again came and threatened Mrs. Bala and her husband to bring out the Sikhs, otherwise they will burn their house. But Mrs. Bala very bravely told them to come inside and search their house-knowing fully well, that Sikhs were hiding inside the home. The crowd after hearing this went away. 9. That on 1st Nov.`84, at about 2 P.M. my devar regained some consciousness, but my husband continued to be unconscious. 10. That when my devar became little conscious my mother-in-law and devar left Mrs. Bala’s house and went to army unit Gurdwara across railway line. 11. That little later, I and my devrani, dressed ourselves in sarees and we two along with my son left for Army Gurdwara, leaving my husband still unconscious in the house of Mrs. Bala. 12. That on 2-11-84, at about 3 P.M. my husband regained consciousness. Then about 3 – 4 neighbors escorted my husband to Army unit Gurdwara and the whole family was together again. 13. That on 4-11-84, we shifted to Delhi Cantt. Gurdwara where a camp was established- we stayed in the camp for next 2 months till 31st Dec.`84. 14. That we came to our house on 31st Dec.`84, and found it was completely looted and burnt. With financial help from relatives and friends, we partially repaired it and tried to restart the life. 15. That on 10-11-84, an FIR was lodged by my chachaji, uncle-who was staying in our adjoining house and was also taking shelter at Delhi Cantt. Gurdwara. (copy enclosed) 16. That my husband suffered severe injury during the beating on 31st Oct.`84, in his ankle. This got worsened with some white powder thrown on him by mob and later when he was partially burnt while he was unconscious on 31st Oct.`84. 17. That he is continuously under treatment at various hospitals. Safdarjung hospital, AIIMS, Jeewan hospital and other private practitioners. 18. That his condition is continuously getting worsened and now he is unable to even walk. 19. That my husband is unable to walk as such is unable to work. He was the only source of income in the family. (Medical reports 11 in No. are enclosed) 20. That the house expenses are being met by me doing tailoring work at my house. 21. That my husband is suffering from 100% disability due to the heavy beating and burning on the night of 31st Oct.`84. 22. That I suffered household loss of Rs.1,20,000/-. (FIR enclosed) 23. That I received a total compensation of Rs.2,000/- only. |
