Affidavit of Nanavati Commission

I, Mukhinder Singh S/o S. Sohan Singh, aged 58 years, R/o B-57, Friends Colony (West), New Delhi-110065, do hereby solemnly affirm and declare as under: -

1.                  That in October/November1984, I alongwith my family were residing at G-1, Maharani Bagh, New Delhi-65.

2.                  That on 31-10-84, in the evening I was with my friend Shri Ramesh Bhandari, who was residing at Akbar Road, New Delhi. He told me that due to anti Sikh sentiments the situation was worsening and advised me to go home and not venture out of the house. Thereafter, I came back to my residence. At about 9 PM, my driver Uttam Singh, whom I have sent to Dehradoon by bus, came to my residence. He was bleeding profusely from his head and his turban had been removed. He told me that at Ashram Chowk he was brutally beaten by mobsters and with great difficulty he managed to run away from that place and save his life. We were highly scared on hearing all the disturbing news and on seeing the condition of our driver. However, no incident took place in our area on 31-10-84.

3.                  That on 1-11-84, at about 11 AM, Ajay Satsangi – a Youth Congress (I) leader of our area, came in our locality in his car. He was particularly noting the houses of Sikhs in the locality. At that time, I was in the courtyard of my house. On seeing me, Mr. Ajay Satsangi looked at me in a peculiar manner and hurriedly reversed his car and disappeared. I know Ajay Satsangi and his parents, who were residing at Eastern Avenue Maharani Bagh. I had removed the nameplate from my house.

4.                  That at about 2:30 PM, I got a telephone call from Shri Kapil Sibal – Senior Advocate, who is my close friend and residing at C-1, Maharani Bagh, New Delhi. From his voice I could note that  Shri Sibal was highly disturbed and nervous. Shri Sibal said, “The mob is passing in front of my house. Please get out of your house immediately. There is no time and you have no time to ask me any questions.” The house of Shri Sibal was at the distance of about 300 meters from my house. My wife was in wheel chair. However, on getting the telephone call from Shri Sibal I alongwith my ailing wife and two minor children ran to the house of Shri Lohia, r/o G-3, Maharani Bagh and concealed ourselves there. I concealed myself in the bathroom of Mr. Lohia, wherefrom I could see the happenings in my house.

5.                  That after some time, a mob of about 200 - 250 persons attacked our house. Before attacking my house the mob attacked the house of Mr. Dhingra, which is about 50 yards. The mob was being led by Mr. Ajay Satsangi and shouting anti Sikh slogans. The mob was having some kind of list in their hands and they were pointing out towards my house saying that this house belongs to a Sikh. They broke open the lock of our main gate and looted the entire valuable household goods and burnt the house by some chemical. I watched the entire incident from the bathroom of Mr. Lohia, where I was hiding.

6.                  That Late Sardarni Mohan Singh and her son Dr. Ravi Singh were residing in G-6, Maharani Bagh, which is situated opposite my house, was not touched. That after the mob had completely burnt my house, I heard them shouting, “Where is D-14?” This house belongs to S. Inderjit Singh – Ex-Chairman Punjab & Sindh Bank. The mob damaged and burnt the Ground Floor of D-14, Maharani Bagh thereafter.

7.      That I suffered a loss of over Rs.40 lakh as on in 1984. On or about 7-11-84, P.S. Sriniwaspuri to lodge my FIR but I was told that the police would only endorse my complaint regarding loss / damage etc. as only one FIR of the entire locality has been lodged. The police endorsed my complaint and tagged it with general FIR. I was given Rs.10,000/- only as compensation. Petty household articles like TV, radio etc. had given to me by the Court on Supurdari from P.S. Sriniwaspuri. I was never called as a witness to the Court regarding my abovesaid complaint.
