Affidavit submitted before Misra Commission

        I, Amit Bararia, the abovenamed deponent, do hereby solemnly affirm and state as under:

1.                  I say that I was travelling from Ahmedabad to Delhi by Ahmedabad Delhi Mail on October 31, 1984.  At about 3.30 PM I saw some people travelling in the train huddled in a circle listening to a radio.  It was then that I learnt that Mrs. Gandhi had been shot at in Delhi.  However, I came to know of her death only after listening to the 6.30 PM bulletin.

2.                  That there was no sign of any tension whatsoever at the Delhi Railway Station when the train reached there.  I saw no problems in getting a three wheeler to Defence Colony.  There was no sign of any trouble on way to Defence Colony where I was then residing.

3.                  That at 8.30 PM I went to the market and while on my way I was mobbed by some people.  They were armed with sticks and were shouting anti Sikh slogans.  Seeing that I was not a sikh they let me go. In the market a vegetable shop owned by a Sikh was burning and a mob was marching up and down shouting slogans.  I could see a car burning.  Seeing that trouble was brewing I decided to go to East of Kailash where a friend of mine lives.  On the road between Kotla Mubarakpur and Defence Colony I saw many cars, scooters and commuters  towards  South were trying to stop buses and vehicles in an attempt to reach home.  There was, however, no sign of the police.  I however saw big convoy of army vehicles.

4.                  The morning of November 1, 1984 I was fairly peaceful but by afternoon the sky had turned absolutely black over the Jangpura Bhogal Area..  I went to that area.  I saw mobs openly plundering and burning shops. Some policemen who were present did nothing to prevent the mob.  Driving over the Ashram flyover I saw a number of  policemen firing into some houses of the Sunlight Colony.  The houses were later identified as those of the Sikhs.

5.                  That on the same day later on, a mob collected in front of a locked house in Lajpat Nagar while a few neighbours were trying to prevent the mob from entering.  A few policemen who were there asked the neighbours to allow the mob to inspect the premises.

6.                  That on the 3rd of November, 1984 in the afternoon I went with a group of concerned citizens to Trilokpuri to carry out relief operations.  What we saw was most shocking and unnerving.  Entire rows of houses were burnt and plundered.  A few pieces of human limbs were still scattered around and dogs were feasting on them.  Inside one of the houses a couple of bodies were still rotting.  There were several mounds of ashes in which one could see the karhas and half burnt human bones.  Some medicos who were with us claimed that there were the remains of atleast 5 to 6 bodies of human beings.  A number of survivors mostly women and old men told us how the attacking mobs had come.

7.                  Attached hereto are four photo-prints of some of the sites in Trilok Puri as seen by me with my own eyes.  I myself took the photos marked A-II to A-IV and the photo marked as A-1 was taken by Satish Sharma.  All the photographs were taken at Trilok Puri, Block No.32 on November, 1984.  I am in possession of  negatives of photographs A-II to A-IV and Mr. Satish Sharma is in possession of the negatives.
