Affidavit of Nanavati Commission

            1, Bir Singh, son of Makhan Singh aged about 60 years, R/o RGB 467, Raghubir Nagar, New Delhi-110018, do hereby solemnly affirm and declare as under :- 

1.                  That in and about October, 1984, I was staying in a rented accommodation at  WZ-61, Ratan Park, Moti Nagar, New Delhi-110015, along with my family, which consisted of my wife, my three sons and a daughter.   At that time, I was running a cable manufacturing unit in partnership with one Mr. Rakesh Sood and the said factory was located  at Nangloi. 

2.                  That on the fateful day of 31st October, 1984, i.e. the day when Smt. Indra Gandhi, the then Prime Minister of India, was assassinated, we had closed our factory at about 5.00 p.m. as usual and till the time we left the factory, no untoward incident happened at the factory premises and I did not come across any untoward incident till I reached home. 

3.                  That in the morning of 1st November, 1984, I got up around 6.00 a.m.  Till that time, everything was calm and I recollect that till about 7.00 a.m. there was nothing unusual which I noticed.  However, soon thereafter at 8.00 A.M.  I heard lot of noise and shouting emanating from the locality in which I was staying.  I was curious and peeped out of my residence in order to ascertain the reason for the same.   

4.                  That as soon as I stepped out of my residence, my neighbor, Mr. Mohan Lal, noticed me and immediately came rushing towards me advising me to rush back to my house as according to him a mob collected outside the colony and were shouting slogans against the Sikhs and that he had heard the men who were leading, instructing their followers, to locate and kill the Sikhs.    

5.                  That I sensed  threat to my life and that of the lives of my family members and requested my neighbor, Mr. Mohan Lal, to help us and with gratitude I put on record that he was forthcoming and all my family members including myself took shelter at his house. 

6.                  That the place at which I was staying in around November, 1984 was a rented accommodation and in fact, my landlord informed me on 3rd of November, 1984 that the mob had come to our house also and had in fact, broken the front door and that the said landlord had pleaded with the mob and told them that the Sikh family which was staying have left and in fact, vacated the premises and that is how my belongings at my residence were saved from being looted or destroyed.  We stayed at our neighbor’s house for two days and thereafter shifted to my residence.   

7.                  That it may not be out of place to mention that I was running a successful cable manufacturing unit in partnership with one Mr. Rakesh Sood and the name of the firm was Uphar Cable Industries.  The unit was located on a rented premises i.e.  at 126/70, Gali Mandirwali, Saini Mohalla, Nangloi, Delhi-110041.  The partnership with Mr. Rakesh Sood was vide a partnership deed 10th , January, 1978. 

8.                  That at this stage, I respectfully put a record that I had extremely good relation with Mr. Rakesh Sood, who belongs to Hindu religion and still have very cordial relation with him, though the partnership was dissolved in the year 1985. 

9.                  That my factory was burnt by unruly mob between 1st November’84, to 3rd November’84, and all the goods along with machines etc. were looted by the mob.  This incident was reported to the police on 04-11-84, (a copy of which is annexed hereto as ANNEXURE `A’) by Mr. Rakesh Sood, who was my partner. 

10.              That again on 28-11-84, my partner Rakesh Sood filed a list of stocks, machinery & Account Books etc.  which were destroyed in the after math of looting & killing which followed the assassination of Mrs. Indira Gandhi, the Prime Minister of India.  The approximate loss in that communication was stated to be Rs. 3.5 lacs.  A copy of communication is attached herewith for your perusal  as ANNEXURE `B’ 

11.              That till date neither my partner nor myself have got any relief from any authority and now the position is that my health is failing me and as I am suffering from TB.   I have been approaching authorities from time to time for redressal  of my grievances but to no effect.  At this stage I submit that Mr. Rakesh Sood, my ex-partner is still willing to substantiate  whatever I have stated herein and is prepared to appear before this Hon’ble Commission examination. 

12.              That I lost my means of lively-hood and also underwent traumatic experiences during November’84 riots and have still not been able to overcome the effects of those dreadful experiences, where persons were burnt alive and even small children were killed and properties looted.  

13.              That it is duty of a welfare state to compensate its citizens who are victim of failure of law enforcing agencies and here is a case of collusion public authorities with rioters.  

14.              That due to this great monetary loss and the tension to look after the family I am suffering from T.B. and as such  I can not work.  Therefore I humbly request that the compensation for the loss suffered by me may kindly be sanctioned.
