Affidavit of Nanavati Commission

I, Jasbir Singh Marwah, S/o Late S. Santokh Singh Marwah, aged 55 yrs., R/o H.No. C-6/218, Yamuna Vihar, Delhi-53, do hereby solemnly affirm and declare as under:- 1. That on Oct./Nov.`84, I and my family were staying at the above address. I had purchased this 70 sq. meter plot from D.D.A. and built a house on it. My wife was running a sewing school under the name and style “Usha Sewing School”. When I returned to my house on 31st Oct.`84, from my office, there was no disturbance in my locality. 2. That on 1st Nov. to celebrate the birthday of Guru Nanak Dev Ji, the local Sikh Sangat had taken out a “Prabhat Pheri” and I was part of that congregation. I returned home at about 7/8 A.M. till this time there was no commotion in the area. 3. That at about 9 A.M. there was lot of commotion in our area. We heard loud shouts coming from a large group of person. A neighbor of our- (a Kashmiri) Kechru by caste, came to me and informed me that Sikhs were being assaulted and killed all round the colony. He advised me to seek safe shelter. 4. That immediately thereafter myself, my wife, one small child hid ourselves in a house under construction nearby. We hid ourselves well and so remained safe till dark on 1st Nov. We saw our house being looted and set on fire but were helpless to do anything. 5. That then our Kashmiri neighbor came to us again and informed me that a large number of Sikhs had already been brutally killed in the colony and the surrounding areas and our hiding place has no longer safe. My two other sons had been given shelter by one Mr. Ahuja, our well wisher. Some of my neighbors advised my sons that they will be safe if they get their hair cut. Feeling themselves helpless, my sons they got their hair cut, much against their wishes. 6. That night I shifted my family to the resident of Mr. Agarwal, who worked with me in D.D.A. We stayed there one night only. But when the miscreants threatened him also he was scared. 7. That sensing the mental agony of my friend Mr.Agrawal, I shifted my family to a lady friend Mrs. Jain. In order to save myself I had to cut my hair on the advise of some well wishers. 8. That at about 4 P.M. a 3rd Nov.`84, military vehicles entered our colony. I collected my family, including my two sons from Mr. Ahuja’s house and reached in Nanak Sar Gurdwara. We stayed there for 1 ½ months and returned to our house thereafter. 9. That during my stay at Gurdwara Nanak Sar (Asharam) I visited my house on 10/11/84, and then filed an FIR with Yamuna Vihar, Police Station that very day (copy attached). A separate FIR was lodged for the said Usha Sewing School-(copy attached). We suffered a loss of Rs.1,65,000/-. I got Rs.12,000/- (in three different instalments) as compensation. 10. That I am entitled to compensation of Rs.1, 53,000/-. |
