Affidavit submitted before Misra Commission

I, Jaswant Singh S/o S. Arjan Singh, aged 54 years, r/o JZ-1268, Satsang Road, Rajgarh Colony, Gandhi Nagar, Delhi-31, do hereby solemnly declare as under on oath: -

1.            I own a wheat grinding shop in Block-32, Trilokpuri. Before November, 1984 riots I had a shop adjoining it.

2.            On 1-11-1984, as usual, in the morning I came to Gurdwara Sis Ganj and reached my shop in Trilokpuri at 8 AM. It was quite peaceful in the way. At that time there was peace in Trilokpuri as well.

3.            From my Trilokpuri shop I took atta and cash lying there and started for my house.

4.           I boarded bus route No.307 to go to Lakshmi Nagar. In the way another bus route No.307 coming from the reverse direction stopped our bus. The driver of that bus enquired from the driver of our bus whether any Sardar was there in the bus. I was the only Sikh passenger in that bus. That driver told that near Parpar Ganj the buses are being stopped, Sikh pulled out and beaten to death. He therefore asked me to get down and not proceed ahead. I got down from the bus.

5.           I reached Block-36, Trilokpuri through the various street of Mayur Vihar via village Kotla. At that time it was very peaceful in the way. At that time some Sikhs were sweeping the floor of Gurdwara of Block-36. There a boy informed me that in front of Chaand Cinema (in Block-5) three Sardars have been murdered. From there I started for my shop. Nothing untoward had happened there till then. There some Sardars who were going out, I stopped them and told that there was danger and they should not go anywhere but remain in their block.

6.            Some persons were standing near my shop in Block-32, Trilokpuri. They enquired from me as to why I had returned so soon. I told them that there is disturbance and Sikhs are being killed. One Kadir, a Mohammedan who resides near my shop was also standing there. He offered me to come to his house and took me there.

7.            From the roof of his house I saw smoke coming out of the 36-Block Gurdwara. It was about 10 – 10:30 AM, by then.

8.            After about half an hour a mob comprising of about 300 – 400 persons came from the wireless road side Block-32 via Block-36.

9.           At about same time a mob of 500 – 600 persons came from the other side (Masjid Road) towards Block-36. Some Sikhs also gathered near the mosque. They stopped the mob from entering Block-32.

10.         ON the Sanjay Gandhi Crossing the mob attacked Sardars and started pelting stones. Sardars also pelted stones to protect themselves. I was seeing all this from the roof of Kadir’s house. This house is quite high and is situated on the main road coming towards Block-32.

11.         The mob coming from the Wireless road turned towards the road of Block-32 and came shouting, “Kill, Kill” two Muslims came forward and made hand folded requests to the mob and tried to stop them from entering colony. But the mob did not listen to them and came inside the block. The mob started pelting stones on the 7 – 8 houses belongings to Sikhs.

12.         The Sardars of these houses and some other Sardars gathered near the toilet and tried to stop the mob. At that time I was at the roof of house No.491. In the meantime Kadir advised me to hid myself so that the mob may not notice me. On his advice I went inside.

13.         I was hearing the sounds of whatever was happening outside. I heard 2-3 fire shots in the noon – In the evening and night I heard the shouts “Maar Do, Pakar Lo” (Kill, Catch). I heard the screams of children and women. There screams were heard every now and then.

14.         Kadir and other Mohammedans guarded my shop safely till night. At midnight Kadir informed me that they could not save my shop. He told me that my shop had been looted. Kadir showed me his arm, which was swollen and told me that when he tried to save some Sardars they beat him also.

15.         After looting my shop Devi shouted from the road that Sardar is also there and he be found. At about 5 AM, some Musalmaans came and told me that the mob had made a programme to search the houses of Musalmaans also and the search would start at 7 AM. They further told me that Devi and his men had come to know that I had hidden myself there. I got frightened and Kadir was scared too. There I got my hair cut, wrapped myself with a bed sheet and after taking a stick in my hand came out alongwith Kadir and his 10 – 12 men who were having lathis with them. Ours looked like a gang of looters. In the way I saw innumerable dead bodies on the road. Kadir and his friends escorted me upto Mayur Vihar crossing. Thereafter I went on bicycle. In the way, at the Madawali gate, some people stopped me. I bade Ram Ram and told them that I am going on duty to the General Hospital. Then they allowed me to proceed further.

16.        Afterwards I came to know that police had arrested Kadir, I went to Shahdara Court to get Kadir bailed out. There I came to know that the cases of all those arrested during the riots were being handled by one advocate namely Lakhani. I met Lakhani and asked his charge for bail. He said that there would be no charges. He told that it was the order of Bhagat Sahib that nothing should be charged foar such cases. He asked me pay Rs.10/- only towards the cost of paper. I gave him Rs.10/-. Kadir was bailed out the next day. This advocate Lakhani is a Congress (I) leader and he was handling the cases of those arrested in riots free of charge, other advocates, were charging full fees.

17.         Now, I have come to know that a meeting was convened at the house of Doctor Ashok, Councilor of Trilokpur and a many persons had attended it. There they decided to collect affidavits to be produced before the Enquiry Commission. These affidavits would reveal that Congress Party had no hand in the riots.
