BEFORE JUSTICE NANAVATI COMMISSION OF INQUIRY ( Witness No : 101 ) Name : Shri Jai Singh On SA I say that that the report at pages 1 and 2 and the movement chart at pages 9 to 13 in file exhibit No.W86/1 were prepared by me and bears my signature. The contents are true. Cross examination by Shri H.S. Phoolka, Senior Advocate on behalf of November ’84 Carnage Justice Committee. I cannot say how many deaths have taken place in the area falling within the Shakarpur Police Station between 31.10.84 and 5.11.84. All those details are contained in the FIRs. FIR Nos. 368, 369 and 370 were recorded on 1.11.84. The next FIR No.372 was recorded on 12.11.84. The FIR No.371 is not with respect to any offence relating to Anti-Sikh Riots. I do not know if the Delhi Government had made an inquiry regarding number of deaths that had taken place within the area of Police Station and that had found 85 deaths had taken place. On 1.11.84 I had not come across with any mob while I was on patrolling duty. I had come across some mobs on 2.11.84. Probably I had also come across one mob on 1.11.84. I did not arrest anyone either on 1.11.84 or 2.11.84 as the mobs did not confront the police. I had posted a picket near School Block on the main road. I had also posted pickets at other points where there was possibility of trouble. There was a picket near Angadh Nagar also. I cannot say whether there was a picket at Laxmi Nagar also. Master Block is in Shakarpur area and there was a picket at Master Block. There was patrolling in Shakarpur area. I cannot say how many total number of incidents of violence had taken place on 1.11.84 without seeing the FIRs and case files. I cannot say how many incidents were investigated along with the FIR as some papers are in Urdu. I cannot say how many incidents were investigated even though statements of about 43 witness were recorded (in Hindi). I say so on the basis of the record which is in Hindi. The FIR was recorded by SI Moolchand on the basis of ‘rukka’ sent by him. SI Moolchand has mentioned the area and with reference to that area the FIR was recorded. All those incidents which had taken place in that area till the time FIR was recorded were mentioned in that FIR. As far as I see through the record subsequent incidents have not been included in that FIR. I had gone to Preet Vihar Area. As no individual had reported the incident and all those incidents were reported by the SI, a common FIR was registered. I did not meet any victim when I had visited those areas and places. I cannot say without counting how many incidents were investigated alongwith FIR No.369. I can supply that information after verifying the record. I will also submit a list of number of incidents investigated alongwith FIR No.370. My answer for registering only one offence in respect of various incidents with reference to FIR Nos.369 and 370 is the same as in the case of FIR No.368. No FIR was registered on 2.11.84 and 3.11.84 as no body had reported commission of any offence on those days. I had also not noticed commission of any cognizable offence on those days. I will prepare a list of number of incidents alongwith FIR Nos. 372, 375, 381 and 390. In FIR No.375 only two deaths were reported. I had demanded extra force on 31.10.84 and on subsequent days also. I had received some additional force on 1.11.84. As far as I remember the army had come in my area on 2.11.84. It had come to my notice after the army had resorted to firing in my area during those days. The distance between Radhu Palace Cinema and Angad Nagar may be about half a kilometer. I had forgotten the names of the localities adjoining Radhu Palace Cinema. I cannot say if Angad Nagar Area starts from across the road from where the Radhu Palace Cinema is situated. ACP, Gandhi Nagar and DCP (East) had also visited my area. I cannot say exactly when they had visited the area. I cannot say definitely on which date they had visited. As far as I remember they used to visit my area at least ones or twice in a day. Whenever they visited my area I used to apprise the situation to them within my area. I cannot say whether Nanakpura was within the area of my Police Station. I have not heard about such locality. I cannot say as I do not remember whose call sign was 06. I also cannot say whose call sign was 60. Even I do not remember my call sign, even after reading the log book what was my call sign and what was the call sign of the Police Station and others also. It is incorrect to suggest that I am deposing falsely before the Commission. My attention is now drawn to page 76 of log book Exhibit No.W86/22. After referring to the number ‘60’ which is written on the top of the page, I say that, that figure indicates the number of the call sign of that Police Station. It may be that my call sign was 10 and I say so after my attention is drawn to entry made at 2010 Hrs. on page 69 in file Exhibit No.W86/21. Mausam Vihar is opposite Preet Vihar and it was then a part of area of Shakarpur Police Station. Read over and found correct ( JAI SINGH )
