BEFORE JUSTICE NANAVATI COMMISSION OF INQUIRY ( Witness No : 112 ) Name : Shri Kuldeep Singh Bhogal On SA I have earlier filed an affidavit dated 01.12.2001 before this Commission. I am shown that affidavit. That bears my signature. I have nothing more to say than what is stated in my affidavit. Cross examination by Shri S.S. Gandhi, Senior Advocate on behalf of Delhi Police : I had not filed any affidavit/statement earlier before any commission or authority inquiring into Anti-sikh riots. I had once appeared before Jain-Aggaral committee and there my statement was recorded regarding loss suffered by me. In that statement I have stated loss suffered by me. It is true for obtaining compensation I had filed an affidavit dated 20th July, 1987 before the Jain-Banerjee committee for compensation. On 10.11.84 I had given a complaint to the police / SHO PS Shriniwaspuri as regards the loss caused to the property. A copy thereof was sent to PM, President etc. It is true that I have not made any complaint earlier to anyone that on 1.11.84 when the crowd had attacked my house and other houses of locality, 15 - 20 policemen were available and they had not done anything to control and disperse the mob. I do not remember if the police had recorded my statement on 8.11.84 in FIR 369 of 84 of Police Station Shriniwaspuri. It is true that in my affidavit dated 29th July, 1987 I had merely referred to the damage caused to my vehicle bearing No.DLL 8516. I say that as I was asked to give information in respect of my truck only, I had stated only that much in that affidavit; otherwise in my complaint to the police I had referred to the damage caused to my household property also. It is true that my statement was recorded by the Committee. I say so after looking at statement which bears my signature. (The Statement is in file 1/137/JJC/87/JPRC/90/SP which is now given Exhibit No.W.112/1). It is true that the complaint dated 7.11.84 which is now shown to me in that file ( Exhibit No.W.112/1) was in respect of vehicles only. My explanation is that we were told that compensation would be paid for loss caused to two vehicles only so I had filed complaint for the loss of vehicles only. Otherwise, as can be seen, from my complaint to the police I had stated about loss caused to my shop, household and vehicles also. It is true that in the enclosure to the complaint I had merely referred to the loss caused to our trucks and not any other property. My explanation is that as we were told that compensation will be paid in respect of vehicles and not for the looted property, I had not referred to any loss caused to my properties. I do not remember if I had earlier complained about the police instigating mob to continue their attack on the houses of Sikhs as stated in paragraph 4 of my affidavit. I do not remember if I had stated earlier that the shop, houses etc. were burnt by throwing some white powder on them. After the riots, I was appointed as President, All India Riot Victim Relief Committee and in that process I had visited Punjab, Kanpur, Bokaro. Thereafter I had enquired if any Commission or authority was looking into the causes and other relevant aspects of anti – Sikh riots but I was told that the time for filing the statements was over. I was often going out of Delhi in 1985 and 1986 in my capacity as the President as the victims who had taken loans and received notices and were put to some difficulties because of that. Soon after the riots I had made representation in my capacity as the President to various authorities for taking appropriate action against the persons who had caused damage to the properties of Sikhs. I had not made any representation regarding the role played by the police or by any other organizations or group of persons. My truck which was burnt was standing near my house. I do not remember if Niku who I had named in my statement was residing behind my house. I do not recollect if I had disclosed to anyone earlier what I have stated in paragraph 6 of my affidavit.
