I had filed an affidavit before Justice Ranganath Mishra Commission of Inquiry. A photocopy of it is shown to me, it bears my signature and I say that it is a correct copy of the affidavit, which I had filed before that Commission. I have also filed one affidavit-dated 24.7.2000 before this Commission. (Both these affidavits are treated as examination-in-chief of the witness).

In addition to that I say that I was a member of the Congress party and I used to work for that party since 1960. Being a member of the Congress Party and an active worker I knew S/Shri Sajjan Kumar, Balwan Khokar, Mahinder Singh Yadav. Shri Sajjan Kumar was the Member of Parliament from our area. As my house was burnt and my household articles were looted, I had gone to Delhi Cantt. Police Station to lodge a complaint. There I had given the name of some of the assailants including those of Shri Sajjan Kumar and Shri Balwan Khokar. At that time the police had told me that I should disclose only the damage caused to my property and should not give the name of the assailants. I had taken with me a written complaint in which I had given the names of the assailants but that was not accepted and the police had taken a different complaint on their own. As I was told that I should not name the assailants, I prepared another complaint and that was later on given to the police and on that basis they had registered an offence. When my evidence was recorded in the court I noticed that Shri Sajjan Kumar was not put up for trial as an accused. Only Shri Balwan Khokar and others were there before the court. Shri Balwan Khokar was the main person who used to organize rallies and processions for the Congress party and particularly Shri Sajjan Kumar.

Cross examination by Shri S.S. Gandhi, Senior Advocate on behalf of Delhi Police.

I had dictated my affidavit which was later on typed by some officer of the Gurudwara and thereafter my signatures were taken on it. Similarly, I had dictated my affidavit filed here in July, 2000, that was also dictated by me first and after it was typed, it was signed by me. I say that whatever I had stated was incorporated in typed copies. I had disclosed in my affidavit what had happened to me in 1984. The affidavit which I had filed before Justice Ranganath Mishra Commission of Inquiry was first read over to me and only after I had found it to be correct I had signed it. I cannot read. When I had gone to the police station I had met the SHO Shri Rohtas Singh. I had not met him earlier between 31st October, 1984 and 14th November, 1984. The mob had first set the gurudwara on fire; thereafter they had looted and set my house on fire. The police had not recorded my statement at any time.

I had gone to the Patiala House Court as I had received summons from that court. That case was in respect of damage caused to my house. Whatever I wanted to say before the court was recorded by the court as my evidence. It is not correct to say that I had not met Shri Rohtas Singh at the police station. It is also not true that Shri Rohtas Singh was not in the police station when I had gone there. Only other policemen whom I had met on 1.11.1984 were the policemen who were near my house. I had not met any other policemen at the police station. The policeman whom I had met near my house was the Incharge of the Police Post (Chowki Incharge) and 6 – 7 policemen attached to the police Chowki. I do not now remember the name of the police officer (Chowki Incharge); very probably he was Om Prakash. I had stated this fact before the court when I had given my deposition.
