On SA

I had earlier filed an affidavit before Justice Ranganath Mishra Commission. A copy of the affidavit shown to me bears my signature and it was the same affidavit I had filed before that Commission. The same is taken on record and marked as Exhibit No.19/1. In November, 1984 I had a flour Mill in Inderpuri. I had good relations with the persons whose names are mentioned in para 3 of my affidavit. When my house was attacked about six to seven policemen were present there. The policemen were telling the mob that you either to kill me, my brother and my daughter or they would kill the persons from the mob. When the mob had burnt my house and had threatened to take away my daughter at that time my brother opened fire. The mob used to went back when we used to open fire but they used to come back again at the instance of the police. My other family members were given protection by the neighbors and they were helped by them. The attack on us had continued from 11.00 AM to 7.00 PM on 1st November, 1984. When it was dark I had jumped into my neighbors house and with their help I got my hair cut. My brother had also escaped from the attack in the similar way. A criminal case was also registered against me for the offence punishable under section 302 IPC. That case had continued for about four to five years. My household articles were damaged and looted by the mob. Ornaments worth Rs.85,000/- were also taken away by the mob. My house was also set on fire. My two trucks which were near my house were also set on fire. I had surrendered before the police on 25th November, 1984. I was bailed out on 28th November, 1984. I was informed by my brother-in-laws that a criminal case was registered against me. I returned to my house on 23rd January, 1985. I have not received any compensation for the damages caused to my properties. I was told that I am not entitled to any compensation because I had killed some persons. My brother Shri Jagjeet Singh was with me during the incident.

Cross examination by Shri S.S.Gandhi, Sr. Advocate, on behalf of Delhi Police.

Whatever was written therein the affidavit the same was written after giving thought to it. I had told the truth in that affidavit. It is true that I had not mentioned in my affidavit that the police had instigated the mob to kill us. I do not remember whether I had filed any other affidavit before any other Commission / Authority other than Justice Ranganath Mishra Commission of Inquiry. I had not given any oral deposition before Justice Ranganath Mishra Commission of Inquiry. I do not know if the police had on their own registered an offence in respect of the burning of my house. I do not know if the police had arrested any person who had committed that offence. I had disclosed everything what had happened, when I was produced before the Metropolitan Magistrate Shri Om Prakash when I was produced before the court for obtaining the bail. I had seen two persons being hit by the shots fired by my brother.

It is false to say that I have given an exaggerated version today and had falsely involved the police.

No cross examination by Shri Ashok Kashyap, Advocate on behalf of Central Government
