BEFORE JUSTICE NANAVATI COMMISSION OF INQUIRY ( Witness No : 35 ) Name : Shri Mohan Singh On SA I had filed an affidavit before Justice Ranganath Mishra Commission of Inquiry. I am shown the affidavit. I identify the signature on it. The affidavit is taken on record and marked as Exhibit No.35/1. In addition to what I have stated in my affidavit, I say that I telephoned to Shri Bhagat sometime between 8.00 and 9.00 PM. I knew Shri H.K.L.Bhagat because I was an old congress (I) worker. I had been to his house many times. I used to visit him often in connection with complaints of our locality. Sometimes, Shri Makhan Singh who was the pradhan of our community and Shri Rampal Saroj who was also a Congress (I) worker, used to accompany with us. Mr.Bhagat had appointed Shri Ramphal Saroj as a leader of the Congress (I) party to look after the problems of our area.. Most of the Sikhs residing in our locality were Congress (I) supporters. I had worked for Mr.Bhagat during his elections. Mr.Gosain was PA of Shri Bhagat. He also knew me. I told Mr. Gosain about what had happened in our locality and also told him that mobs had killed two of my brothers. I told Mr. Gosain that killings are going on and some help is required. Dr. Ashok was a member of Congress party and also councilor of our area. Dr.Ashok was in the mob and he had incited the mob to kill us. When I had gone to police station for reporting about the death of my brothers, I found that there was one Head Constable and two – three police constables in the police station. They did not listen to me, on the contrary they drove me out by saying that nothing can be done so. I went to the police headquarters on my cycle. At the police headquarter one armed police guard was seen at the entrance. I told him I wanted to see some officer as the local police were not taking any action even though his two brothers were killed. He did not allow me to meet any of the officer and had asked me to go away from here. He recognized that me I am a Sardar. I had also told him that I am a Sardar. I told him that many Sikhs have been killed by the mob therefore I wanted to see the higher police officer for help. Cross examination by Shri S.S.Gandhi, Sr. Advocate on behalf of Delhi Police. The police had come near our block. One Halvadar Rajbir Singh, alongwith him one constable was there. Havaldar Rajbir had told us that all the Sikhs should go to their respective houses. When I had gone to the police station one police constable had given stick blows to me. I do not know his name. When I was in the relief camp the police had recorded my statement. I stayed in the camp for about 5 to 6 months. I had gone to the camp on 4th November, 1984 and 15 days thereafter my statement was recorded. I cannot say whether my statement was recorded on 5.11.84. Whatever I have stated in my affidavit filed before Justice Ranganath Mishra Commission of Inquiry was told to the police also. I had told the police that I was beaten by the police. It is incorrect to say that ------ have not stated. I had mentioned in my evidence that I had been to police headquarter. It is not correct to say that I had said to the police that I did not wait and then I had gone to the office of Indian Express. I do not know whether any offence was registered against Inspector ---, ASHO , Constable Munshi Ram of Kalyan Puri Police Station. I had given evidence in Kakardooma Courts.
