BEFORE JUSTICE NANAVATI COMMISSION OF INQUIRY ( Witness No : 36 ) Name : Shri Parsa Singh On SA I had earlier filed an affidavit before Justice Ranganath Mishra Commission of Inquiry. I am shown that affidavit and I say that it bears my signature. The affidavit is taken on record and marked as Exhibit No.36/1. I also say that what is stated therein is correct. In addition to what I have stated in the affidavit I say that on 31.10.1984 Shri ShoorVir Tyagi, SHO had told me that he had received orders from his superior officers that all the persons in the locality having firearm be asked to surrender the same, so we made to surrender their arms. Therefore, I took him alongwith me to all those persons holding license firearms and they were all infact surrendered. In all about 15 to 16 guns were surrendered by the persons of the locality. All those guns were collected from sardars. By Mr.Tyagi, alongwith Shri Madan Lal Bakshi, SI and four or five other constables. On 1.11.84 in the morning a crowd was seen coming towards our locality. Shri Shoorvir Singh Tyagi, Madan Lal Bakshi and some constables were ahead of that mob. Shri Tyagi had told us to go to our respective houses. At that time I had told him that we were already at our houses and why he is asking us to go our houses and why he was not telling anything to the mob. Thereupon he had pointed a revolver at me and said that I am speaking too much and if I did not go to my house I will be shot dead. The mob was lead by Dr. Ashok Gupta who was residing in our locality. He was also a local Congress Leader. The mob was pelting stones at us. Thereafter, we had moved to the open park and two or three persons having guns with them in the park started firing in air. This went till about 6.00 PM. Mr.Shoorvir Tyagi, Madan Lal Bakshi and others had taken about 40 sikhs into custody and they were taken to the police station. About 25 persons were detained and those who were old were allowed to go. We were then sent to the jail because a case was registered against us. That case had lasted for about 3 to 4 years. I remained in jail for about 15 days. I had lodged a report in respect of the damage caused to my house and other properties. My house was burnt after I was arrested on 1st November, 1984. About 100 to 150 huts were burnt. All the pakka properties/houses were also burnt. About 16 sikhs were killed in our locality. Some of them were ladies. Cross examination by Shri S.S.Gandhi, Sr. Advocate on behalf of Delhi Police. In my affidavit which was filed before Justice Ranganath Mishra Commission of Inquiry. I had complained about Mr.Tyagi and other police officers. It is not correct to say that I had stated in that affidavit what I have deposed before this Commission today. The affidavit was dictated by me and it was written by someone less. I do not remember who had taken it down. The affidavit was read over to me before I signed it. It is incorrect to say that I had not stated to that person what I have stated today before this Commission. I left Delhi within two or three days after I was released from the Jail. I had gone to Punjab and stayed there for two years. I had not come to Delhi in between. I had not met Mr.Tyagi after released from jail and before went to Punjab. No policemen had tried to contact me while I was in Punjab. On being question again to witness, the witness replies that, he used to come Delhi of and on, even while he was staying in Punjab. It is not correct to say that affidavit filed before Justice Ranganath Mishra Commission was false. It is also incorrect to say that what I have stated today is false.
