On SA

I had filed an affidavit before this Commission. I am shown that affidavit. It bears my signature. The affidavit is taken on record and marked as Exhibit No.46/1. In block No.11 there were 40 to 50 Jugghi’s. Alongwith my jugghi all other jugghi’s were also burnt. All those jugghis were having plastic sheets as roofs. At the time of the incident, October/November 1984, I had only one daughter. I had run with my daughter and the mob had come. Mr.Ashok Kumar had given a push to me and therefore my daughter had fallen from my hand and as a result of that my daughter had received an serious head injury. It is incorrectly stated in my affidavit that I had two daughters at that time. After I was attacked like that by the mob I went to a park between Gurudwara and Block No.11. The mobs had attempted to attack on those persons who were in the park also but they were prevented from doing so by the Sikhs who were collected there. The attacks had continued till night on 1st November, 1984. The police had come there and prevented Sikhs who were in the park from firing. They had also taken away their guns. After about 2 hrs. the police had again come there and taken away 40 or 50 Sikhs. The pakka houses which were close to the road were also set on fire. My father-in-law was taken away by the mob which was led by Dr. Ashok Gupta. Block No.13 was about 5 min. walk from my jugghi. Block No.12 was in between Block No.11 and Block No.13.

Cross examination by Shri S.S.Gandhi, Sr. Advocate on behalf of Delhi Police.

I had not filed any affidavit earlier nor I had given any statement before any authority. Before my marriage I was staying with my father in a house in Block No.11. All the 40 to 50 jugghis in Block No.11, were of Sikhs. They had all migrated from Punjab. I had lodged an FIR after about 10 days. I had gone away to Alwar after about 5 to 6 months of the incident. In between for about two months I had gone to Jalandhar. For about 2 to 3 months before I had gone to Jalandhar I had stayed with my father. My father house was not burnt but the household articles were looted therefrom. I had not give written complaint to the police. I had orally told the police about the incident and the police had recorded the statement. About 500 people had collected in the park. The police had come near the park after about few hours. The police had come to the park in the evening. The mob had fired some shots at the persons who had collected in the park. Those Sikhs who were in the park had also fired some shots in the air. I had not gone to the police station before I had lodged an FIR as I was very much afraid to move out. I had not gone the police station to enquire about, my complaint as to what had happened to my complaint with regard to disappearance of my father-in-law. It is not true that we were informed by the police that we should go and identify my father-in-law out of the dead bodies lying in the Sabzi Mandi Mortuary.
